Debate Continues Around 28CFR23’s Proposed Changes – Part 1 There are pressing issues involving the collection, assessment, information sharing, and optimal processing of criminal and counter-terrorism intelligence. Debate continues on Part 28 Section 23 of the Code of Federal Regulations as law enforcement agencies wait for the U.S. Department of Justice to act upon proposed revisions to the code. DOJ’s proposed changes to 28CFR23’s criminal intelligence systems operating policies – a federal regulation containing guidelines originally written in 1980 – met with significant opposition by the American Civil Liberties Union (ACLU) and other privacy advocacy groups. This section of the code governs intelligence sharing by local, tribal, state and federal law enforcement agencies. The DOJ proposed revisions and offered them for public comment, with the review period ending last September. Justice is expected to decide on the revisions this year.
